Terms of Service

These Terms of Service ("Terms") are an agreement between you (and the organization you represent) and DohouGroup, a sole proprietorship registered in Ontario, Canada, which operates the RestorationGapFinder service ("RestorationGapFinder", "we", "us", or "our"). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

The service

RestorationGapFinder helps roofing and restoration contractors identify line items that may be missing from an insurance estimate. It reads an estimate you upload, checks it against a set of rules and a short questionnaire, and produces a report of potentially missing items with supporting justifications.

The service is an informational tool, not legal, insurance, or professional advice. It does not determine what you are owed, does not guarantee that any item is required or covered, and does not guarantee any claim, supplement, or payment outcome. Whether an item applies depends on the applicable building code, the manufacturer's instructions, the field conditions, and the specific policy. You are responsible for reviewing and verifying the output and for anything you submit to an adjuster or insurer.

Eligibility and accounts

• You must be at least 18 years old and able to enter into a contract.
• If you use the service for an organization, you represent that you are authorized to bind that organization to these Terms.
• You must provide accurate account information and verify your email address.
• You are responsible for keeping your credentials secure and for activity under your account.

Acceptable use

You agree not to:

• use the service unlawfully or to upload content you do not have the right to use;
• misrepresent information to an insurer or adjuster;
• attempt to disrupt, reverse engineer, or gain unauthorized access to the service or another organization's data;
• resell or provide the service to third parties except as permitted by your plan.

Your content

You keep ownership of the estimates, photos, and other content you upload ("Your Content"). You grant us a limited license to store and process Your Content solely to provide the service to you. You are responsible for having the rights and permissions needed to upload Your Content and any personal information it contains.

Plans, billing, and payment

• Current plans and prices are shown on our pricing page. Paid plans are billed through Stripe.
• Subscriptions renew automatically for the billing period you select until you cancel. You can cancel at any time; cancellation takes effect at the end of the current period.
• Fees are exclusive of applicable taxes, which may be added.
• Except where required by law, fees already paid are non-refundable.

Intellectual property

The service, including its software, rules, design, and the RestorationGapFinder name and brand, is owned by DohouGroup and protected by law. These Terms do not grant you any rights in it except the right to use the service as permitted.

Third-party services

The service relies on third-party providers (such as Stripe for payments). Your use of those services may be subject to their own terms, and we are not responsible for third-party services.

Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose. We do not warrant that the service will be uninterrupted or error-free, or that its output is complete, accurate, or suitable for any particular claim. Nothing in the service is legal, insurance, or professional advice.

Limitation of liability

To the maximum extent permitted by law, DohouGroup will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost revenue, or claim outcomes, arising from your use of the service. To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us for the service in the three months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold DohouGroup harmless from claims and costs arising out of Your Content, your use of the service, or your breach of these Terms.

Termination

You may stop using the service and close your account at any time. We may suspend or terminate your access if you breach these Terms or use the service in a way that could harm the service or others. Provisions that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will survive.

Changes

We may update the service and these Terms from time to time. When we make material changes to these Terms, we will update the effective date above and, where appropriate, notify you. Continuing to use the service after changes take effect means you accept the updated Terms.

Dispute resolution

Before starting a formal legal proceeding, you agree to first contact us at privacy@restorationgapfinder.com and try to resolve the dispute informally for at least 30 days.

General

• Severability — if any provision of these Terms is found unenforceable, the rest remain in effect.
• Entire agreement — these Terms, together with the Privacy Policy, are the entire agreement between you and DohouGroup regarding the service.
• Assignment — you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Force majeure — neither party is liable for delays or failures caused by events beyond its reasonable control.
• Waiver — our failure to enforce a provision is not a waiver of it.

Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute arising from these Terms or the service.
